Suppressed and Dismissed Illegal Search – Possession of Cocaine

Outcome: Suppressed/Dismissed

Description: Client was walking down the street. The police asked him to come over. Client did not move. The police asked him again to come over. Client did not move again. The police asked him a third time to come over. Client then walked over. Police then conducted a pat frisk on my client. As a result, four bags of crack cocaine fell on the ground. We filed a motion to suppress due to this being an illegal search violating my client’s 4th Amendment rights. After an evidentiary hearing, the motion was allowed. The judge agreed it was an illegal search, and the case was dismissed.
