Driving Under the Influence (DUI) Amended to Reckless Driving and Refusal to Submit to a Chemical Test Dismissed

Our client was charged with Driving Under the Influence of Alcohol and Refusing to Submit to a Chemical Test in Rhode Island. Both have mandatory punishments of a license suspension, fines and fees, alcohol counseling or DUI school and community service. In addition, a DUI is a misdemeanor criminal charge in Rhode Island.

Our attorneys then began discussing the case with the prosecutor. We highlighted inconsistencies and negotiated with the prosecutor, while presenting them with arguments and evidence we were prepared to present at trial.

As a result of our negotiations, we were able to secure an amended charge of Reckless Driving for our client for the DUI, and Refusal to Submit to a Chemical Test was dismissed. The reckless was filed so will be expunged and removed from our clients criminal record after one year.
