Our client was driving their car and was accused of text messaging on their cell phone while operating a motor vehicle. Rhode Island General Law 31-22-30 states no person shall use a wireless handset or personal wireless communication device to compose, read, or send text messages while driving a motor vehicle. It is a traffic violation that can result in a fine ranging from $100-$250, a conviction on your driving record and a potential license suspension. This can cause an increase in your insurance premiums.
We discussed the situation with our client. After negotiation with the police they agreed to dismiss the case. Since the case was dismissed, this charge did not go on our client’s driving record.
