Our client received an Application of Complaint for a Clerk Magistrate’s Hearing in Massachusetts for Possession of a Counterfeit Note and Uttering a Counterfeit Note. Both of these offenses are felony charges in Massachusetts.
Massachusetts General Law Chapter 276 Section 12 and Section 10 state that if charged and convicted of Possession of a Counterfeit Note and/or Uttering a Counterfeit Note our client could have faced up to 5 years at the state prison or up to a $1,000 fine and no more than 1 year in jail.
We performed an investigation into the charges and discussed the circumstances of what happened with our client. At the hearing, we spoke with the police and through our negotiations came to an agreement not to issue the complaint. This meant our client did not have to face the criminal charges going forward, and they did not have a criminal record from this incident.
