Our client faced charges for operating a vehicle without insurance and violating speed restrictions under the Colin Foote sanctions in Rhode Island. The Colin Foote sanctions have potential serious penalties, including a potential license suspension for up to 1 year and fines that pose threats to people’s driving privileges and finances along with 60 hours of community service and 60 hours of driver retraining. Colin Foote sanctions occur when you get four convictions within 18 months of each other.
After discussing the situation with our client, our client decided to set the case for trial. At a trial, the prosecution has the burden to prove the charges by clear and convincing evidence. This means they have to bring evidence and/or witnesses into court to prove the charges.
At the trial, our attorneys presented arguments to the judge highlighting that the police department couldn’t meet this burden. As a result, the judge agreed to not order Colin Foote sanctions. This outcome allowed our client to retain their driving privileges, not have to do community service and not have to do driver retraining.
