Motion to Vacate Allowed – Suspension Rescinded Rhode Island Traffic Tribunal

January, 2020

Our client came to us confused as to why the DMV was suspending their license longer than they expected. We investigated the matter and discovered there was a default judgment against our client in the Rhode Island Traffic Tribunal where they were facing nearly $1,000 in fines and fees and a 6 month license suspension. Our client missed this court date and the court entered what is called a “default judgment.”

We decided to file a Motion to Vacate the Judgment in the Rhode Island Traffic Tribunal. This Motion was seeking to re-open the case. The Motion was allowed and we were able to convince the police prosecutor to dismiss the ticket all together. The ticket was dismissed.

Therefore, our client did not owe the fines and fees to the court, and the license suspension was rescinded.
