No Complaint Issues at Clerk Magistrate’s Hearing in Massachusetts

Our client was charged with Leaving the Scene of Property Damage and Negligent Operation of a Motor Vehicle in Massachusetts for an alleged accident that happened on the highway. Our client was summonsed in for a Clerk Magistrate’s hearing. We made arguments to the Clerk on why a complaint should not issue and were able to show from evidence that our client essentially did not commit the crimes that were alleged. As a result, the Clerk did not issue a complaint and set the case down for a further date. If our client has no new violations in that time – the case will be dismissed.
