No Probable Cause Found on Leaving the Scene of Property Damage

Our client received a notice for a Clerk Magistrate’s Hearing in Massachusetts, where they were alleged to have committed the offense of Leaving the Scene of Property Damage. This is a misdemeanor criminal offense in Massachusetts. Leaving the Scene of Property Damage has potential jail time associated with it, a possible license suspension, fines and fees, potential probation and has the potential of creating a criminal record for a defendant.

We did our own investigation and were able to show through evidence that we obtained that there was no actual property damage from the accident our client was alleged to have been in. Therefore, we argued to the Clerk Magistrate that were was no “probable cause” to charge our client.

The Clerk Magistrate agreed with our argument and did not issue the complaint. Our client walked away from the incident without a criminal record and with their name cleared.
