Our client was accused of violating their probation. After researching case law, we were able to show the Probation Officer that they could not violate our client based on certain allegations. In addition, we were able to show some violations were not willful. After having a Final Surrender Hearing where the Probation Office had to prove by a preponderance of the evidence that our client was in violation of their probation, the judge ruled there was no violation of probation. In addition, the judge terminated our client’s probation.
